Denial reason: Denied in underwriting

Denied in Underwriting After You Were Pre-Approved?

Reviewed by Tanner Cook, NMLS #2090424 · Updated

Short answer

A pre-approval is usually based on what you told the lender and a quick automated check. Underwriting is where every document gets verified, so a problem with income, credit, assets or the property can surface late. A denial from one lender is one underwriter’s decision under one set of rules, not a final answer from the whole market. Get the written reasons, then have another loan officer review the full file before your contract deadlines pass.

How lenders see it

Why this happens

A pre-approval isn’t an approval

Most pre-approval letters are issued after a credit pull and an automated underwriting run based on the numbers in your application. Nobody has read your tax returns line by line, traced every deposit, or seen the house yet. When an underwriter does, the file can look different from the one that earned the letter.

What underwriters find late

Late-stage problems include income that calculates lower once the full tax returns are reviewed, a new car loan or credit card that shows up on a credit refresh, deposits that can’t be traced to a source, a job change or cut in hours caught on the final employment check, an appraisal below the price, and condo or title issues. Each one has a different fix, and some have none at that particular lender.

Suspended, conditioned or denied

Conditions are items the underwriter needs before signing off. A suspension means the underwriter can’t decide without more information. A denial is a decision. A suspended file can often be cleared at the same lender; a denied file usually needs new information or a lender whose guidelines fit it.

Your denial notice has to say why

Under the Equal Credit Opportunity Act and its Regulation B, a lender that denies a completed application must send a written notice within 30 days that either lists the specific principal reasons or tells you how to request them. “You didn’t meet our internal standards” is not specific enough. If a credit report played a part, federal credit reporting law also requires the notice to show the credit score used and the key factors behind it.

Ways we may be able to save it

Which of these fits depends on your full file and the program. None of them is a promise; each is something we check on a second look.

Find the real reason first

We read the denial notice, the conditions list and your documents together. Sometimes the real issue is a calculation or a missing document, not the borrower.

Re-underwrite under the guideline as written

Cornerstone underwrites most loans in-house and doesn’t stack extra company rules (overlays) on top of the agency or investor guideline. A file that failed one lender’s overlay may meet the guideline itself.

How lender overlays cause denials

Change how income is documented

If your tax returns understate what you earn, non-QM options can document income with 12 or 24 months of bank statements, a CPA- or tax-preparer-prepared P&L, 1099s, or eligible assets. They’re usually priced higher than agency loans, so they’re a tool, not a default.

Self-employed income denials

Protect the appraisal and the clock

Depending on the investor and how it was ordered, an existing appraisal can sometimes be transferred to a new lender, which saves time. It isn’t possible on every file. Talk to your agent or attorney about your financing contingency so you know your real deadline.

Get a real approval before the next contract

If this deal can’t be saved in time, an underwritten (TBD) pre-approval puts your file through underwriting before you choose a house, so your next offer is backed by an underwriter’s decision.

What to send us

Gather what you can from this list. You don’t need every item to start the conversation.

  • The denial (adverse action) notice and any statement of reasons you requested
  • Your pre-approval letter and most recent Loan Estimate
  • The underwriter’s conditions list or emails explaining the decision
  • Your purchase contract, showing the financing contingency and closing dates
  • Your last two years of tax returns (all pages and schedules) and recent pay stubs or W-2s
  • The last two months of statements for every account you plan to use
  • The appraisal report, if one was completed

For real estate agents

If your buyer was denied in underwriting, send me the conditions list and the denial reason the day you hear about it. I’ll tell you plainly whether the file looks fixable, which guideline set it might fit, and what a realistic timeline looks like. Contract deadlines are a question for your broker or the buyer’s attorney.

Honest limits

Some late denials can’t be fixed within a contract’s timeline: income that has truly dropped, a credit event too recent for any available program, or an appraisal gap the buyer can’t cover. When that’s the case we’ll say so and lay out what would change the answer, such as more time, more documented income, or a different property.

Questions

Frequently asked questions

Can I appeal a mortgage denial?

There’s no formal appeals process. You can ask the same lender to reconsider if you have new information, such as a corrected credit report or a missing document. If the denial came from that lender’s own rules or the way it calculated your income, a lender with different guidelines may reach a different decision.

Does a mortgage denial hurt my credit score?

The denial itself isn’t reported to the credit bureaus. The credit inquiry from the application is. The CFPB says mortgage credit checks within 45 days of the first one generally count as a single inquiry. If your first pull was longer ago, a new check may count separately, though a single inquiry usually has a small effect.

How fast can another lender take over my loan?

It depends on how complete your documents are, whether the appraisal can be used, and how complex your income is. A file with a clear denial reason and full documents moves much faster than one that has to be rebuilt. We’ll give you an honest read on timing once we see the file.

What if my lender won’t tell me why I was denied?

Under Regulation B, if the notice didn’t list specific reasons, it must tell you how to request them. Ask in writing within 60 days of the notice, and the lender then has 30 days to answer.

Should I apply with several lenders right after a denial?

Not blindly. It’s usually smarter to have one experienced loan officer review the denial reason first and tell you which guideline set, if any, fits your file, then apply where it fits.
